Terms of Service

1. Acceptance of Terms

By accessing or using Pretty Maps ("the Service"), operated by Pretty Maps, based in Coquitlam, British Columbia, Canada, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you may not use our Service.

You must be at least 13 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

2. License Grant

Upon purchase and successful payment, we grant you a non-exclusive, non-transferable, perpetual, worldwide license to use, download, and print the poster design for personal, non-commercial purposes only.

This license permits you to:

  • Download the digital file(s) for your personal use
  • Print the design as many times as you wish for personal use
  • Resize or modify the design for personal display purposes

This license does NOT permit you to:

  • Use the design for any commercial purposes without written permission
  • Resell, redistribute, or share the digital files with others
  • Claim the design as your own work
  • Use the design in any way that violates applicable laws or regulations

3. Intellectual Property

Service Ownership: The Pretty Maps website, software, design tools, and all related intellectual property are owned by Pretty Maps and protected by copyright, trademark, and other intellectual property laws.

Map Data: The map data used in our service is provided by OpenStreetMap contributors and is available under the Open Data Commons Open Database License (ODbL). We acknowledge and respect the rights of OpenStreetMap contributors.

Generated Posters: You retain ownership of the specific poster design you create and purchase, subject to the license terms in Section 2. However, Pretty Maps retains all rights to the underlying software, templates, and design elements used to generate the poster.

4. User Accounts and Responsibilities

When you create an account with us, you agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account
  • Use the Service legally, ethically, and in compliance with these Terms

Prohibited Activities: You agree not to:

  • Use automated systems (bots, scrapers) to access the Service
  • Attempt to reverse engineer, decompile, or extract the source code
  • Interfere with or disrupt the Service or servers
  • Violate any applicable laws or regulations
  • Upload malicious code or attempt to gain unauthorized access
  • Impersonate another person or entity
  • Use the Service to create content that infringes on others' rights

5. Service Availability and Modifications

We strive to provide reliable service, but we do not guarantee that the Service will be uninterrupted, secure, or error-free. We reserve the right to:

  • Modify, suspend, or discontinue any part of the Service at any time
  • Perform maintenance that may temporarily limit access
  • Update features, pricing, or functionality

We will make reasonable efforts to notify you of significant changes, but we are not liable for any modification, suspension, or discontinuance of the Service.

6. Payment and Refunds

All purchases are processed through our payment provider, Polar.sh. Prices are listed in the currency displayed at checkout and are subject to change without notice.

Refund Policy: All sales are generally final. We reserve the right to issue refunds at our sole discretion in the following cases:

  • Technical defects in the delivered poster file that cannot be resolved
  • Failure to deliver the purchased product
  • Duplicate charges or payment processing errors

Refund requests must be submitted within 14 days of purchase with a description of the issue. We do not offer refunds for change of mind, dissatisfaction with the design you created, or user error in creating the design.

7. Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the maximum extent permitted by law, we disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability and fitness for a particular purpose
  • Non-infringement of third-party rights
  • Accuracy, reliability, or completeness of content
  • That the Service will meet your requirements or expectations
  • That the Service will be uninterrupted, secure, or error-free

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Pretty Maps and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or information
  • Cost of substitute services
  • Personal injury or property damage

In no event shall our total liability to you for all claims exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100 CAD, whichever is greater.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless Pretty Maps and its officers, directors, employees, contractors, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Any content you submit or create using the Service

10. Termination

We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms
  • Fraudulent or illegal activity
  • Harmful behavior toward other users or our staff
  • Extended periods of inactivity

Upon termination, your right to use the Service will immediately cease. However, licenses for posters you have already purchased will remain valid according to Section 2. Sections that by their nature should survive termination shall survive, including but not limited to Sections 3, 6, 7, 8, 9, 11, and 13.

You may delete your account at any time by contacting us using contact form. Please refer to our Privacy Policy for information about data deletion.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or your use of the Service shall be resolved in the courts of British Columbia, Canada. You agree to submit to the personal jurisdiction of these courts.

Informal Resolution: Before filing any formal claim, you agree to contact us using contact form to attempt to resolve the dispute informally. We commit to working with you in good faith to reach a reasonable resolution.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page.

For significant changes that materially affect your rights, we will make reasonable efforts to notify you by email (if you have provided one) or through a prominent notice on our Service.

Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

13. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pretty Maps regarding the Service and supersede all prior agreements and understandings.

Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights or provisions.

Assignment: You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights.
